These Terms of Service ("Terms") govern your access to and use of the website, demos, and services (the "Services") provided by ByteMe Miami LLC, doing business as AnvilWired ("AnvilWired," "we," "us," or "our"). By using the Services or starting a subscription, you agree to these Terms.
1. Our services
AnvilWired designs, builds, hosts, and maintains websites and related lead-generation tools for home-service businesses, including features such as lead capture, missed-call text-back, follow-up automation, and review and listing optimization. Some services, including IT and technical support, may be provided through our affiliate BytesPCS under separate arrangements.
2. Free demo
We may build a demo site for you at no cost and with no obligation. A demo is for evaluation only, may use sample content and images, and remains our property until you start a paid subscription and we launch your live site.
3. Subscriptions, billing, and cancellation
- Recurring billing. Paid plans are billed monthly in advance through our payment processor, Stripe, to the payment method on file.
- Pricing. Current plan pricing is shown on our site. We may change pricing with reasonable advance notice; changes apply to future billing periods.
- Month-to-month. Plans renew automatically each month until cancelled. There is no long-term contract.
- Cancellation. You may cancel at any time by contacting us. Cancellation stops future charges and takes effect at the end of the current billing period.
- No partial refunds. Except where required by law, monthly fees already charged are non-refundable.
- Failed payments. If a payment fails, we may suspend or pause your Services until the balance is resolved.
4. Your responsibilities
- Provide accurate business information and respond promptly to requests we need to deliver the Services
- Ensure you have the rights to any content, logos, photos, or trademarks you provide to us
- Use the Services lawfully and not for any prohibited, harmful, or misleading purpose
- Keep your account and contact details current
5. Intellectual property
We retain ownership of our templates, code, designs, and underlying systems. While your subscription is active, we grant you a limited license to use the website we build and host for you. You own the content you provide and any domain registered in your name. If you cancel, you keep your domain and content, but our templates, hosting, and proprietary systems are not transferred.
6. Third-party services
The Services rely on third-party platforms (for example, hosting, payments, messaging, and Google services). Your use of those features may be subject to the third parties' terms, and we are not responsible for their availability or actions.
7. Disclaimers
The Services are provided "as is" and "as available." We do not guarantee specific results, including any particular number of leads, calls, search rankings, or revenue. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
8. Limitation of liability
To the fullest extent permitted by law, AnvilWired and ByteMe Miami LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three months before the claim arose.
9. Indemnification
You agree to indemnify and hold harmless AnvilWired and ByteMe Miami LLC from claims, losses, and expenses arising out of your content, your use of the Services, or your violation of these Terms or applicable law.
10. Termination
You may stop using the Services and cancel at any time. We may suspend or terminate the Services if you breach these Terms, fail to pay, or use the Services unlawfully. Sections that by their nature should survive termination will survive.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Services after changes take effect means you accept the updated Terms.
